LIKEWIZE SERVICES UK LIMITED Terms & Conditions

Overview:

This Recycling Service is provided by LIKEWIZE SERVICES UK LIMITED (company registered in England with registration number 08401611) with its registered office at Crewe Logistics Park, Jack Mills Way, Shavington, Crewe, CW2 5XF, England, (“Likewize”).

“Recycling Service” means the reuse or recycling of the Eligible Device or its parts.

“Likewize” means the party providing this Recycling Service.

“Customer” means the person using this Recycling Service and agreeing to these terms and conditions.

“Eligible Device” means any device that is eligible for this Recycling Service as determined by Likewize in its sole discretion.

Customer represents and warrants that:

- they are the sole owner of the Eligible Device or have been authorised by the owner of the Eligible Device and that they are able to make decisions with regards to the Eligible Device

- there are no liens, encumbrances or security interests in or attached to the Eligible Device and that no other party has a legal interest in it;

- any items Customer seeks to recycle through the Recycling Service shall not infringe on any third-party intellectual property right (including copyright, trademarks, patent, trade secrets or other proprietary right);

- the Eligible Device is not counterfeit, stolen or fraudulent

Ownership transfers to Likewize

Upon receipt and acceptance of the Eligible Device by Likewize, title of ownership in such Eligible Device transfers to Likewize from the Customer and Customer disclaims any further right, title or interest in and to the Eligible Device or any items contained therein.

Customer’s responsibility for their data

Customer agrees that they have the sole responsibility to keep a separate backup copy of any files, games, pictures, music downloads, personal information relating to you or your friends or other data (which we collectively refer to as Data) before transferring ownership of the Eligible Device to Likewize; and that Customer has taken reasonable steps to eliminate and delete all Data that is personal or confidential from the Eligible Device. Please refer to (i) for Apple devices - Apple’s guidance on deletion of Data, storing Data to iCloud or other backup, and resetting the Eligible Device to factory settings (ii) for other manufactures – their guidance on deletion of Data, storing Data to the cloud or other backup, and resetting the Eligible Device to factory settings.

The Customer agrees to remove any memory cards and the sim card (where relevant) from the Eligible Device before sending the Eligible Device to Likewize. Sim cards can contain private information and may enable unauthorised use of your Network airtime. If you fail to remove your Sim card, you agree to release Likewize from all claims, losses or damages with respect to the use of Sim card arising before, or after receipt of your Eligible Device.

Data recovery is not a part of the Recycling Service and Likewize accept no responsibility or liability for any lost Data once the Eligible Device is in the ownership of Likewize.

Where a Eligible Device is received by Likewize which, when the Eligible Device is turned on, appears not to have been reset to factory settings and Data is immediately obvious from the screen, then Likewize shall take reasonable actions to wipe or remove any stored Data from the Eligible Device by resetting the Eligible Device to factory settings in accordance with the manufacturer’s recommended guidelines and utilizing the functions on the Eligible Device to do so. Likewize shall have no further obligations in respect of wiping or removing the Data Likewize accepts no responsibility for failure to maintain the integrity or confidentiality of any Data, and does not warrant or guarantee that resetting the Eligible Device to factory settings will permanently delete any Data or personal information. Where any Eligible Device received by Likewize still has a memory card, SIM, packaging or accessories then you agree Likewize may remove the memory card or sim card which shall not be returned to you but securely disposed of.

Please note as part of the recycling process it is the intention that your Eligible Device will be resold or transferred to third parties who may subsequently transfer the Eligible Device to others. Likewize has no control over the actions of such third parties and does not know the identity of the parties to whom the Eligible Device may be passed onto. It is therefore important that you remove all personal information and Data relating not just to you but all your contacts and friends.

Please reset your Eligible Device to factory settings and refer to the manufacturer’s instructions on how to do that.

If the Eligible Device is registered as lost or stolen, Likewize will retain it in accordance with the Recycler Charter. The Eligible Device will NOT be returned to Customer nor will there be any value given to the Customer unless Customer is able to prove the legitimate ownership of the Eligible Device within 28 days. It is the responsibility of Customer to inform Likewize that they are contesting this decision. If Customer is not able to prove the legitimate ownership of the Eligible Device, it will be treated in accordance with the Recycler Charter requirements.

General Terms and Conditions

This Recycling Service is provided for lawful purposes only, and Customer agrees to indemnify Likewize and any of their directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this Recycling Service on Customer’s behalf or for any breach of these terms and conditions by Customer.

Likewize will under no circumstances be liable for any special, indirect, incidental or consequential damages resulting from this Recycling Service.

To the extent permitted by applicable law, Likewize and their affiliates’ entire liability, if any, from any cause whatsoever with respect to this Recycling Service shall not exceed 100% of the market value of the device.

General Data Protection Regulations (GDPR)

Personal Information stored on your Eligible Device, about you or your friends, may well be personal data as defined by General Data Protection Regulations (GDPR). However, if you have carried out your responsibilities set out above (in particular section headed “Customers responsibility for their data” above), there should be no personal data which is apparent on your Eligible Device when Likewize receives the Eligible Device.

In the unlikely event that Likewize receives your Eligible Device which still contains personal data, Likewize shall not use that personal data for any purpose. Likewize shall, as referred to in section headed “Customers responsibility for their data” above, reset your Eligible Device to factory settings so that the personal data is no longer present when you turn on the Eligible Device.

You hereby agree that Likewize may resell or transfer your Eligible Device to a third party having first reset the Eligible Device (where necessary) to factory settings.
